ARTICLE 2 - SUBJECT OF THE CONTRACT

The subject of this contract is the scope, duration, subscription fee of the subscription application made by the SUBSCRIBER to the online website ( skillsky.com , hereinafter referred to as SITE) and SkillsSky mobile device application containing the educational contents of SkillsSky. It is the determination of the rights and obligations of the parties in accordance with the provisions of the Law on the Protection of Consumers and the Regulation on Subscription Contracts in relation to all its basic features.

ARTICLE 3 - SUBSCRIPTION SCOPE

SkillsSky subscription covers the user rights of educational support content for children with special needs, for which SkillsSky has intellectual and industrial property rights. This right to use is limited to the way of use provided by the access package selected by the SUBSCRIBER.

ARTICLE 4 - SERVICES TO BE PROVIDED DURING THE SUBSCRIPTION PERIOD

In the training package selected by the SUBSCRIBER;

• 3-stage evaluation,
• Ability to view and print the individual training plan,
• Being able to conduct training sessions at any time and as many times as they want,
• To be able to see the records of the sessions held,
• To be able to follow the development of the child with a development report,
• Online Sessions,

ARTICLE 5 - SUBSCRIPTION PERIOD

The SkillsSky subscription period can be 1 (ONE) month, 3 (THREE) months, 6 (SIX) months, or 12 (TWELVE) months, according to the payment plan chosen by the SUBSCRIBER. At the end of these periods, the subscription will not be extended automatically, the SUBSCRIBER must select the payment plan and pay at the end of the training period.

Regarding Paid Services offered in subscription form, SkillsSky offers different subscription periods so you can choose the one that best meets your needs.

ARTICLE 6 - RIGHTS AND OBLIGATIONS OF THE PARTIES

6.1. The SUBSCRIBER declares and undertakes that the information given while subscribing to SkillsSky reflects the truth, and that SkillsSky will compensate all damages that will be incurred due to the falsehood of this information.

6.2. The SUBSCRIBER must use the "username" when entering the site and the "password" created while subscribing. SUBSCRIBER cannot give their password to other persons or organizations. The SUBSCRIBER has the right to use the password in person. This right of use is limited to the way of use provided by the access package chosen, and cannot be rented or sold to third parties for free or for free. For this reason, all responsibility that may arise belongs to the SUBSCRIBER. SkillsSky's SUBSCRIBER reserves the right to claim all kinds of compensation and other claims arising from such unauthorized use.

6.3. The SUBSCRIBER may not use the SkillsSky website in any way that violates public order, violates general morality and personality rights, disturbs and harasses others / members, violates the intellectual and copyrights of others, or sends messages. In addition, SUBSCRIBER cannot engage in activities (spam, virus, etc.) or transactions that prevent or make it difficult for others to use the services. In such cases, all kinds of legal, criminal, administrative and financial responsibility belong to the SUBSCRIBER / member.

6.4. Despite all the administrative and technical measures it has taken, SkillsSky will not be liable for damages arising from the reading of subscriber data by unauthorized persons and the slight fault of SkillsSky that may come to subscriber software and data. The subscriber has agreed in advance not to claim compensation from SkillsSky for damages that may occur due to only slight fault of SkillsSky due to the use of SkillsSky.

6.5. SkillsSky reserves the right to change the content of the site and mobile device application at any time, to change or terminate any service provided to users.

6.6. SkillsSky will not be liable in the event that the transactions cannot be completed or canceled due to technical malfunctions or problems arising from the slight fault of the services to be provided under this contract. With regard to the service provided, situations such as interruption or suspension of the service due to the decisions of official institutions or legal practices or legal technical problems, obligations are considered as force majeure, and SkillsSky will not be liable in such cases.

6.7. SkillsSky is authorized to send notification e-mails to the e-mail addresses registered with the SUBSCRIBERS and notification SMS to their mobile phones within the framework of Article 6/2 of the Regulation on Commercial Communication and Commercial Electronic Messages and in accordance with this subscription agreement.

6.8. The parties acknowledge and declare that all computer records belonging to SkillsSky shall be taken as valid, binding, definitive and exclusive evidence in accordance with Article 193 of the Code of Civil Procedure and that such records constitute an evidence agreement.

6.9. SUBSCRIBER accepts and declares that the copyright of all products and services, information, visual and audio elements, electronic materials on the website skillsky.com and mobile device application belongs to SRL YAZILIM VE TİCARET. Will not copy, reproduce, transmit, modify, adapt, translate, convert to source code, reverse engineer or disassemble any content, files, visual and audio elements, electronic materials, information, all products and services on the website and mobile device application. , accepts that it will not use for commercial purposes. Otherwise, it accepts that legal action will be initiated within the framework of the provisions of FSEK numbered 5846.

6.10. SkillsSky reserves the right to change the course hours after the online course hours have been agreed with the mutual consent of both parties. The SUBSCRIBER has the right to change the course time 24 hours before the agreed course time. If the SUBSCRIBER cancels less than 24 hours before the lesson, that session will be abandoned.

ARTICLE 7 - PROTECTION OF YOUR PERSONAL DATA

7.1. As the data controller, SkillsSky provides your personal data within the scope stipulated in the relevant legislation; SkillsSky asks for your very limited personal information in order to provide the products and services offered to you and to understand the identity of the user and this information will not be transmitted to third parties and will not be used for commercial purposes.

7.2. The SUBSCRIBER declares, accepts and undertakes that SkillsSky fulfills its obligation to clarify.

ARTICLE 8 - RIGHT TO WITHDRAWAL

No fee will be charged for the first 15 (FIFTEEN) days of usage experience and training from the SUBSCRIBER, and then from the payment plans chosen;

• There is no right of withdrawal for 1 (ONE) month subscription and no refund will be made,
• 3 (THREE) months subscription has no right of withdrawal and no refund,
• When cancellation of 6 (SIX) month subscription is requested, the entire month in which the request is submitted will be charged. The remaining amount will be refunded. The time used will be calculated with 1 (ONE) monthly subscription fee.
• When cancellation of 12 (twelve) months subscription is requested, the entire month in which the request is submitted will be charged. The remaining amount will be refunded. The time used will be calculated with 1 (ONE) monthly subscription fee.

ARTICLE 9 - TERMINATION OF THE CONTRACT

SkillsSky may terminate the contract unilaterally by canceling the subscription of the SUBSCRIBER without giving any reason and without notice, if it is of the opinion that the SUBSCRIBER uses his password contrary to the provisions of the contract, makes use of the service incorrectly, against the laws and honesty rules, and acts against the obligations of this contract. The SUBSCRIBER accepts and undertakes that it accepts these matters and that it will not claim any compensation or other claims from SkillsSky for the termination of the subscription in this way.

ARTICLE 10 - ENFORCEMENT

The subscription registration of the SUBSCRIBER means that it has read and accepted all articles included in this subscription agreement. This contract was concluded electronically at the time of subscription of the SUBSCRIBER and entered into force mutually. This agreement will remain in effect until the expiry of the subscription period, the subscription of the SUBSCRIBER or the cancellation of the subscription by SkillsSky.
